Terms & Conditions for The Ball Labs

This website is operated by The Ball Labs ("we", "us", or "our"). By accessing or using our website and services ("Service"), or placing an order, you agree to these Terms & Conditions ("Terms"). If you do not accept all Terms, please do not use our Services.

Eligibility

You must be at least 18 years old (or of legal age in your jurisdiction) to purchase from us. You may not use our products for illegal or unauthorized purposes.

Sales & Payment

• All sales, payments, and deposits are final. The only exceptions are:
  We cannot fulfill your order,
  We ship the wrong animal,
  The animal arrives dead on arrival (DOA) — reported within 1 hour of delivery with photographic/video evidence.
• Payment Methods Accepted:
  Credit/debit cards (2.9% processing fee)
  ACH transfers (1% processing fee)
  PayPal
• Payment Plans:
  Available on animals over $500
  25% non-refundable deposit required
  Remaining balance due within 30 days
  Failure to complete payment on time will result in forfeiture of the animal and deposit
• Abandoned payments or deposits may or may not be applied as store credit at our discretion.
• We reserve the right to refuse service, limit purchase quantities, or cancel orders.

Animal Description & Genetics

• We guarantee recessive and het genetics.
• Co-dominant and incomplete dominant traits are identified to the best of our ability. Some genes may be masked in multi-gene animals and are not guaranteed.
• Sex of animals is accurate to the best of our knowledge. Mistakes in sexing are rare but possible. If reported within 48 hours of delivery with documentation, we will work with the buyer on a resolution.

Live Arrival Guarantee

• Applies only if:
  Shipped via FedEx Priority Overnight
  Temperatures are between 40°F and 90°F at origin and destination
  A responsible party is present to receive and sign for the package on the first delivery attempt
  DOA is reported within 1 hour of delivery with video and photo evidence
• If these conditions are not met, the live arrival guarantee is void.
• We may delay shipping at our discretion based on weather or routing concerns.

Health Guarantee

• Animals are guaranteed to be healthy and feeding at the time of shipment.
• This guarantee does not cover issues arising from improper care or husbandry after arrival.
• Wild-caught or imported animals will be clearly labeled and may carry different guarantees.

Returns & Refunds

• No returns accepted due to biosecurity risks.
• Refunds or replacements are considered only in the event of:
  DOA,
  Incorrect animal shipped,
  Inability to fulfill the order.
• Shipping costs are non-refundable. Buyer is responsible for return shipping (if applicable).

Shipping Terms

• Shipping is available within the continental United States.
• We ship Monday-Wednesday for next-day arrival.
• We use insulated boxes and heat/cool packs as needed.
• Shipping is calculated at checkout or invoiced separately.

Liability Disclaimer

• All animals and services are provided "as is" without warranty of fitness or merchantability.
• We are not responsible for injuries, illness, or property damage resulting from animal interactions.
• The Ball Labs is not liable for indirect, incidental, or consequential damages beyond the original purchase price.

Indemnification

• You agree to indemnify and hold harmless The Ball Labs and its affiliates from any claims arising from your use of our animals or services, or your violation of these Terms.

Modifications & Updates

• We reserve the right to update these Terms at any time. Continued use of our site or services constitutes acceptance of any changes.

Third-Party Links & Tools

Our site may contain third-party links or tools. We are not responsible for their content or reliability.

User Content

• Any feedback or comments may be used by us without obligation. We may remove user content that violates these Terms or any applicable law.

Prohibited Uses

You are prohibited from using our site or content:

• For any unlawful purpose
• To violate any law or third-party rights
• To distribute malware or harmful code
• To infringe on intellectual property rights

Governing Law

• These Terms are governed by the laws of the State of Colorado, without regard to conflict of laws. Disputes will be handled in the courts of that jurisdiction.
